For the purposes of this Privacy Notice, personal information means any information relating to an identified or identifiable individual. The type of data that we collect about you depends on how you interact with us and/or with the Site and is described in greater detail below.

PERSONAL INFORMATION REGARDING CHILDREN UNDER THE AGE OF 14
This Privacy Notice is designed to protect children. Our Site does not target minors under the age of 14. No person under the age of 14 may provide any personal information to or on this Site without the consent and supervision of their legal guardian. We do not knowingly collect personal information from minors under the age of 14. If you create a user account with us and we discover that you are under the age of 14, we will delete your registration information and any other personal information received, and subsequently inform you by email of the deletion of the account. WHAT PERSONAL INFORMATION WE COLLECT
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site.
Additionally, when you sign up to become a member, make a purchase or attempt to make a purchase through the Site, we may collect certain information from you, including your name, birth year, billing address, shipping address, type of credit card, last 4 digits of credit card number, order history, IP address, email address, phone number, gender, language, size and product preferences.
HOW WE COLLECT YOUR PERSONAL INFORMATION
You directly provide Browns with most of the data we collect. We collect data and process data when you:
- Register online or place an order for any of our products or services
- Provide information such as your email, name, and postal code when completing an in-store purchase & returns
- Voluntarily complete customer survey/contests
- Use or view our website via your browser's cookies
- Sign up, receive, open, click our marketing emails
- Engage in social media interactions
- Engage in customer service interactions
From time to time, we may collect the following types of personal information from third parties for the purposes described in “HOW WE USE YOUR PERSONAL INFORMATION”:
- Personal information shared by marketing partners and service providers that helps Browns provide more relevant products and advertising or to better address the demands of our customers.
- Exceptionally, personal information from law enforcement or other governmental authorities.
We collect personal information using the following technologies:
- “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, please consult our Cookie Policy.
- “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
- “Web beacons,” “tags,” are electronic files used to record information about how you browse the Site.
- “Pixels” are 1x1 images created with a small piece of HTML coding, used to track behavior when a user lands a website page or clicks into an email.
We record customer service calls and maintain a transcript of chats (such as, chats with our live agents and chatbots, including artificial intelligence chatbots) for quality assurance and training.
We may use chat technologies provided by third-party vendors to operate our chat and chatbot services, including the Browns AI virtual assistant. These vendors, and other third parties we work with, may access, record and use the information shared through your chats or calls with us, including to generate transcripts and summaries, for the purposes described in this Privacy Notice. Please do not use our chat services or the Browns AI virtual assistant if you do not want us to monitor or record those communications.
When you use the Browns AI virtual assistant, you consent to the collection of any personal information that you choose to provide. In general, this may include your full name, email, location and the questions or comments you submit. We request that you not provide any confidential or privileged information or sensitive personal information when using the Browns AI virtual assistant.
We may also automatically collect other informations when you use the Browns AI virtual assistant, including through machine learning tools that help us assess the quality of, and improve, these interactions.
Data collected:
- Navigation data: IP address; User-Agent (web browser information) and web browser cookie, which reveal the Visitors/Customers date and time of visit; type of device used to access the website; location; pages and products visited; basket content; purchased products);
- Chat/interaction data: messages exchanged with support; date and time of message; date, time, and content of replies to surveys; customer’s clicks on pop-ups and/or banners);
- Historical data regarding prior navigation and chat/interaction.
- Identification data (such as full name, email, phone number etc.)
In certain clearly identified stores, and in order to ensure the safety of our customers, employees, and property, we use a video surveillance system in designated public areas of the premises, such as entrances, exits, checkout counters, and main aisles. The recordings are used exclusively to prevent and investigate incidents, including theft and dangerous behavior. Image collection is strictly limited to areas where there is no reasonable expectation of privacy, in compliance with applicable legislation.
Our stores are also equipped with traffic cameras that collect anonymised data within the store. This data is used to make inferences about age and gender, but does not constitute personal information, as it does not identify or relate to any identifiable individual.
Video recordings are securely stored and accessible only to a limited number of authorized personnel. All footage is automatically deleted after a maximum retention period of 30 days, except in cases where extended storage is required for investigative or evidentiary purposes. We are committed to safeguarding the confidentiality and rights of individuals captured on video, who may exercise their access rights in accordance with applicable laws. You can change your cookie settings at any time. This allows you to adjust your consent choices and manage the types of cookies you wish to accept or decline.
HOW WE USE YOUR PERSONAL INFORMATION
We use the personal information that we collect to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations) (the legal basis for this processing is to perform the contract that we have entered with you).
Additionally, we use your personal information:
- To communicate with you
- To screen our orders for potential risk or fraud and comply with our legal obligations (the legal basis for this processing is the legitimate interest of preventing fraud and to secure our website and compliance with our legal obligations)
- To process and track returns and to help detect and prevent fraud and otherwise administer our loss prevention program

- To improve and optimize our website, for example, by generating analytics about how our customers browse and interact with the Site and to assess the success of our marketing, retargeting and advertising campaigns. - When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services or third-party related products (the legal basis for this processing is the legitimate interest of direct marketing and, if required by applicable law, your consent to market and advertise our related products or services or a third-party’s products). You can always unsubscribe from or choose not to receive our commercial or promotional emails and messages using the option provided in the message itself.
- To provide and improve the Browns AI virtual assistant and our services, including for support and troubleshooting
- To enhance the safety and security of our services, and to comply with our legal obligations.
We may disclose information you provide to the Browns AI virtual assistant to our service providers, including those service providers that provide the functionality underlying the Browns AI virtual assistant. We may also disclose de-identified or aggregated information about your interactions with the Browns AI virtual assistant with third parties.
When you use the Browns AI virtual assistant, the personal information you provide may be transferred outside the province and/or country where you are located. Please see “CROSSJURISDICTIONAL TRANSFERS“ for more information.
SHARING YOUR PERSONAL INFORMATION WITH THIRD PARTIES
We share your personal information with third parties to help us use your personal information, as described above.
- Affiliates: We share your personal information with our affiliates and subsidiaries for the same purposes as described in the “HOW WE USE YOUR INFORMATION” section. Furthermore, please note that this type of disclosure might lead to a cross-border transfer of your personal information. Please see the section titled “CROSSJURISDICTIONAL TRANSFERS” for more details
- Service providers: We share your personal information with our service providers which process the payments made on our website, host our website and deliver our products. Furthermore, please note that this type of disclosure might lead to a cross-border transfer of your personal information. - Fraud and security service providers: We share your personal information with Forter, a fraud and abuse detection service provider, which collects information about your interactions with our website (including device, connection, transaction and behavioural data) to help us detect and prevent fraud and abuse. - Marketing partners: from time to time, we may share your personal information with our marketing partners to help us deliver personalized advertising on certain platforms and to track the effectiveness of our advertising. We may also provide our marketing partners with de-identified information and aggregated data to generate “lookalike audiences” (i.e., anonymous audiences likely to be interested in our products because they share common characteristics to Browns’ existing customers) or similar marketing strategies. Some non-personally identifiable information (including aggregate data) in a de-identified form shared with our marketing partners may be used by these partners for their own use (including, for example, tracking the efficiency of their own services or advertising).
- Cloud storage providers.
- Corporate transactions: We may disclose your personal information in the context of a business transaction such as a merger, financing, acquisition, sale, or other similar corporate transactions
- Law enforcement or legal requirements: We will share your personal information to comply with applicable laws and regulations, to respond to a subpoena, warrant or other lawful request for information we receive, or to otherwise protect our rights
- Consent: We will also share your personal information if you have given your consent to do so.
BEHAVIOURAL ADVERTISING
As described above, we use your personal information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.
HOW WE STORE YOUR PERSONAL INFORMATION
Browns will store your information for as long as necessary to fulfill the purpose for which we collect it and for as long as we are required by law to access the information to meet our legal requirements. Your personal information may be transferred to, and stored in, jurisdictions outside of Canada, as described under “CROSSJURISDICTIONAL TRANSFERS” below.
If you are no longer a Browns customer and would like your account information to be anonymized, you can contact our customer service representatives at privacy@brownsshoes.com . However, please note that even after your personal information is anonymized, we have a legal requirement to keep strictly essential personal information that ensures we meet regulatory requirements, resolve disputes, prevent fraud, and abuse, or enforce our Terms & Conditions.
CROSSJURISDICTIONAL TRANSFERS
Your personal information may be transferred to and stored in secured locations and on servers controlled by Browns or its service providers located in various jurisdictions for the same purposes described in “HOW WE USE YOUR PERSONAL INFORMATION”. Your personal information may be transferred to, and stored in, jurisdictions outside of Canada. Where we transfer your personal information across jurisdictions, we will ensure that your personal information is treated securely in accordance with this Policy and applicable law. PROTECTION OF YOUR PERSONAL INFORMATION
Browns ensures that all its partners and suppliers comply with our data and rights protection standards and that your data is secured through methods approved within the relevant Data Protection laws. Please contact us if you would like further information about how we protect your information.
Browns uses the appropriate physical, technical and organization measures to appropriately secure the personal information received, including protection against unauthorized or unlawful processing, against accidental loss, destruction or damage, by way of negotiating thorough contracts with our technology suppliers, implementing policies, training our employees, protecting our network, keeping technology up to date, applying latest security patches, restricting access to distribution frame rooms and limiting access to data within technology solutions.
However, no method of safeguarding personal information can guarantee absolute security. As much as we follow applicable law and put in place measure to secure your personal information, we cannot guarantee the security of any of the information that is transmitted to us. Also, the transmission of data over the internet contains inherent risk and cannot guarantee that the data that you transmit to us will be secure.
DATA DELETION POLICY
At Browns, we are committed to protecting the privacy and data of our users. This Data Deletion Policy outlines the steps for deleting your data from the Browns Platform (being the Browns website located at www.brownsshoes.com and the Browns mobile application, collectively). If you have any concerns or questions about this policy, please contact our Customer Care team at 1.866.720.7463.
This Data Deletion Policy forms part of the Browns Terms and Conditions. For full details, please refer to our Terms and Conditions and our Privacy Notice, both available at www.brownsshoes.com or through the Browns mobile application.
DELETING YOUR ACCOUNT AND ASSOCIATED DATA
If you wish to delete your account and associated data from the Browns Platform, you may do so through the following steps:
1. Open the Browns app on your device.
3. Go to the “Settings” or “Account” section.
4. Locate the option for “Delete Account”.
5. Follow the on-screen prompts to confirm the deletion of your account and associated data.
6. Once you complete the deletion process, your account information and associated data will be permanently deleted from our systems.
Please note that you are responsible for maintaining the security of your customer account on the Platform, including your password. Please ensure that your deletion request is made from your own account.
REQUESTING DELETION BY EMAIL
You may also request deletion of your account and associated data by contacting our Privacy team by email Privacy@Brownsshoes.com. This process may take up to thirty (30) days to complete. If you have an order that is still being processed, fulfilled, or delivered at the time of your request, your account and associated data will not be deleted until that order has been completed. Once your deletion request has been finalised, you will receive a confirmation email.
DELETING APP DATA ON DEVICE
In addition to deleting your account, you can also remove the app data stored on your device by following these steps:
1. Open the settings on your device.
2. Navigate to the “Apps” or “Application Manager” section.
3. Locate and select the Browns app from the list.
4. Tap on “Clear Data” or “Delete App Data” option.
5. Confirm the deletion of the app data when prompted.
Please note that clearing local app data does not delete your customer account or the data held on Browns' systems. To delete your account and server-side data, please follow the steps in the section above.
DELETING THE BROWNS MOBILE APPLICATION FROM YOUR DEVICE
iOS (iPhone or iPad):
1. Locate the App: Find the Browns app on your home screen.
2. Long-Press the App Icon: Tap and hold the app icon until a menu appears, or all the icons start jiggling.
3. Delete the App:
a. If a menu appears, select “Remove App” or “Delete App.”
b. If the icons are jiggling, tap the small “X” or “-” symbol on the app icon.
4. Confirm Deletion: A pop-up will appear; select “Delete” to confirm and remove the app from your device.
Android
1. Open App Drawer: Swipe up or tap the app drawer to view all installed apps.
2. Find the App: Locate the Browns app in your app drawer or on your home screen.
3. Long-Press the App Icon: Tap and hold the app icon until options appear.
4. Uninstall the App:
a. Tap “Uninstall” in the options menu, or drag the icon to the “Uninstall” or “Remove” option at the top of the screen.
5. Confirm Deletion: When prompted, select “OK” or “Uninstall” to remove the app from your device.
Please note that uninstalling the Browns mobile application from your device does not delete your customer account or the data held on Browns' systems. To delete your account and associated data, please follow the steps in the "Deleting Your Account and Associated Data" section above.
CONFIRMATION AND CUSTOMER CARE
If you wish to verify that your data has been deleted, please contact our Customer Care team at 1.866.720.7463.
DATA RETENTION AND ANONYMISED DATA
Please note that some anonymized and aggregated data may be retained for analytical purposes in compliance with applicable laws and regulations, including the laws of the Province of Quebec. Such data will not be identifiable to any specific individual.
Browns may also retain certain information including, but not limited to transaction data where required by law or where necessary to fulfil legitimate business purposes (for example, to resolve disputes, enforce our agreements, or comply with legal obligations). Any such retention will be carried out in accordance with our Privacy Notice.
MINORS
The Browns Platform is not intended for use by individuals under the age of majority. If you are under the legal age of majority in your jurisdiction of residence, please do not create an account or submit personal information through the Platform. If we believe that an account belongs to an individual under the age of majority, the account may be deleted and cancelled without notice.
CHANGES TO THIS POLICY GOVERNING LAW
This Data Deletion Policy, and any use of the Browns Platform, shall be governed by and construed in accordance with the laws applicable in the Province of Quebec, without regard to conflict of law rules. Both Browns and you agree to the exclusive jurisdiction of the courts of the Province of Quebec.
CHANGES TO THIS POLICY
Browns reserves the right to amend this Data Deletion Policy at its sole discretion, without prior notice. Your continued use of the Platform shall constitute your consent to any such modifications. We recommend that you check the Platform from time to time for updates.
YOUR DATA PROTECTION RIGHTS
Browns would like to make sure you are fully aware of all your data protection rights.
Every user is entitled to the following:
The right to access
You have the right to request from us a confirmation as to whether personal information concerning you has been processed and if such personal information has been processed, have access to it and be informed of the corresponding retention period(s). Also, you have the right to request copies of your personal information that we have collected. Browns may charge a reasonable fee for providing you with copies or transcriptions of your personal information. In such case, we will inform you of the approximate cost prior to providing the information to you. Please note that we use your email as your unique identifier.
The right to correction
You have the right to request that Our Company correct any information you believe is inaccurate. You also have the right to request Our Company to complete information you believe is incomplete.
The right to withdraw consent
If the processing of your personal information is based on your consent, you have the right to withdraw consent at any time.
